Brainstork (“We”, “Us” or “Our”) is committed to protecting the privacy of the customers and end users of our Site and Services. This Privacy Policy describes what information we collect when you use Brainstork’s site (www.brainstork.com), services and content. It also describes how we store, transfer, use, and delete that information, and your rights in connection with that information. If you do not agree with the terms, do not access or use the Services, Websites or any other aspect of Brainstork‘s business. 

 

This policy applies where we are acting as a Data Controller with respect to the Personal Data; and Data Processor with respect to the Interview Data of users of our Services. Our customers are the controller of the Interview Data. For content and data that you upload to or make available through the Service (“User Content”), you are responsible for ensuring this content is in accordance with our Terms of Service, and that the content is not violating other users’ privacy.

Information we collect, process and store

 

As described in this Privacy Policy, we may collect and process certain Personal Data from or about you in connection with your use of, or your submissions to, the Site and the provision of the Service. We will only collect and process information that we need to deliver the service to you, and to continue to maintain and develop the service. “Personal Data” generally includes information that may be used to identify you. We may collect the following categories of Personal Data:

 

  • User Account Information: Users that choose to register in BrainStork, will have to provide a valid e-mail adress.

  • Transaction Information: Our paying customers provides us billing information such as banking information, billing e-mail and/or billing address.

  • Usage Information: When you use our services we collect and process the following information to provide a better service. These information is anonymized immediately after your session ends.

    • Device Information: We collect  information about computer or mobile device you used for accessing or using our websites and services. This Information includes, hardware model, operating system and version, connected audio and video devices, unique device identifiers and mobile network information.

    • Technical Log Data: We collect technical log data about your use of the services such as; the browser type and version, your bandwidth, your IP address, clickstream data, date/time stamps and pages you visited on our websites.

    • Cookies: We may collect certain Personal Data using cookies and other technologies, such as web beacons, device IDs or geolocation in order to administer the website, analyze the trends and track users’ movements in our websites.

  • Customer Support Information: We may use your account, usage, e-mail and transaction information in order to provide adequate customer support.

  • Product & Marketing Communication: We may process information that you provide to us for the purpose of subscribing to our email newsletters. You can unsubscribe from our newsletters anytime if you don’t want to receive product & marketing mails. 

 

We process the Interview Data on behalf of our customers. “Interview Data” includes the data (visuals, presentations, videos and questions) uploaded by our customers and the data submitted by the customers and individuals granted Access to a room by our customers when using the services. The categories of “Interview Data”  are as follows:

 

  • Name: The participants can be invited by a link and a password by our customers. Prior to joining the room the participants are asked to enter a name. You may use a nickname or a false name to remain anonymous!

  • E-mail: Our customers can invite their customers and participants via email to register. Once registered our customer may send scheduling information.

  • User Content: Visuals, presentations, videos, concepts and questions uploaded by our customers to conduct the interview.

  • Video and Audio Recording: The sessions are recorded automatically so that our customers can analyze the discussion after it ends and transcribe it. Our Customers are then responsible for collecting consents from all participants in the meeting prior to starting the recording. They are also responsible for storing and processing the recording in compliance with regulations after downloading it from Brainstork. 

  • Written Responses: During the Interview, the moderators can collect written responses via chat window, multiple choice questions, open ended questions or moderator chat window. All of the written responses are stored automatically so that our customers can analyze the discussion. Our Customers are responsible for storing and processing the written responses in compliance with regulations after downloading it from Brainstork.

Purpose of information collection

 

We collect data for various purposes: 

 

  • To provide, maintain, improve and protect our Services, Websites and Business

  • For billing, account management and other administrative matters.

  • To notify you about changes to our Service

  • To allow you to participate in interactive features of our Service when you choose to do so

  • To provide customer support

  • To gather analysis or valuable information so that we can improve our Service

  • To monitor the usage of our Service

  • To detect, prevent and address technical issues

We implement technical and organizational security measures  and precautions to safeguard your Personal and Interview Data. Please note, however, we cannot fully eliminate security risks associated with the storage and transmission of Personal and Interview Data. It is your responsibility to secure your password and keep your account confidential, and not to share your credentials with others. If you have reason to believe that the security of your account has been compromised, please notify us immediately via email at compliance@brainstork.com

Data retention

 

The “Interview Data” described in this privacy policy are made available to our customers, so they can generate ideas, gather feedback, evaluate concepts, test usability, and understand their customers better. ”Personal Data” of the unregistered participants are destroyed after the completion of the project. We will retain our customers and registered users “Personal Data” for as long as is necessary to fulfill the purposes for which we obtained the “Personal Data”, including to provide the Service, or for such longer period as may be required or permitted by applicable law. We will also retain the “Personal Data” of our customers and registered users as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Your rights

Data subjects in the European Economic Area, European Union, Switzerland, and certain other jurisdictions have certain rights under applicable data protection law, including the right to request confirmation from us as to whether or not we are processing your Personal Data. You also have the following rights according to the applicable data protection law:

  • Request modification and rectification of your personal data

  • Request deletion of your personal data

  • Object to processing of your personal data

  • Data portability

  • Lodge a complaint

If you withdraw your consent for processing your personal data, we will destroy all data associated with the entire interview and alert our partners and Customers to do the same. Changes to this policy

We may change this privacy policy anytime due to changes in laws, regulations, industry standards or our business. In case of a change, we will notify you via e-mail or our service before it takes effect. By using Brainstork on or after that effective date, you agree to the new policy. If you disagree with any changes to this privacy policy, you will need to stop using our services and delete your account or contact your organization's administrator.
